Intellectual Property Policy

This Intellectual Property Policy (“Policy”) outlines the rights, responsibilities, and procedures governing the use of intellectual property on the Thinktopia platform, operated by LaClaire. (“we,” “us,” or “our”). We respect intellectual property laws and expect all users to do the same.
1. Definitions
- "Thinktopia" refers to the AI story generation platform operated by LaClaire.
- "Services" means all Thinktopia products, tools, and educational content offered online.
- "User" means any parent, teacher, student, or organization using the Services.
- "User Content" refers to all text, images, audio, and data uploaded or entered by a user.
- "Generated Content" means any AI-generated story, image, or educational material created through the Thinktopia platform.
2. Thinktopia’s Intellectual Property
All proprietary materials provided by Thinktopia are owned by LaClaire. and protected under Canadian, U.S., and international copyright and trademark laws. This includes, but is not limited to:
- Software source code, platform architecture, and AI models
- Website design, user interface, and visual layouts
- Logos, names, and branding assets
- Educational templates, marketing materials, and documentation
Users may not reproduce, copy, modify, or redistribute these materials without written consent from LaClaire.
3. User-Generated and AI-Generated Content
a) Ownership
- Users retain full ownership of their uploaded content (e.g., names, prompts, or character descriptions).
- AI-generated stories and illustrations (“Generated Content”) are co-licensed between the user and Thinktopia for non-exclusive use.
- Users may download, share, or print Generated Content for personal or educational purposes.
b) License to Thinktopia
By using the Services, you grant Thinktopia a limited, worldwide, royalty-free license to store, process, and display your uploaded and generated content for the sole purpose of operating, maintaining, and improving the platform.
c) Restrictions
- You may not use Thinktopia-generated content for commercial resale, publishing, or mass reproduction without written permission.
- You may not upload content that infringes upon any third party’s intellectual property rights.
- Teachers and parents are responsible for ensuring all uploaded content complies with copyright and educational fair-use laws.
4. Prohibited Activities
- Copying, distributing, or publicly displaying Thinktopia’s proprietary materials without authorization.
- Attempting to reverse engineer, extract, or replicate any portion of Thinktopia’s AI models or databases.
- Uploading materials you do not own or have permission to use.
- Using Thinktopia trademarks or branding in any promotional or commercial way without written authorization.
5. Copyright and DMCA Compliance
Thinktopia follows the Digital Millennium Copyright Act (DMCA) and Canadian Copyright Act in addressing intellectual property complaints.
a) Submitting a Copyright Complaint
If you believe your copyrighted work has been used or displayed in violation of your rights, please submit a written notice including:
- Your full legal name and signature (physical or electronic)
- A description of the copyrighted material
- A description of where the infringing content appears on Thinktopia
- Your contact information (address, phone, email)
- A statement of good faith belief that the use is unauthorized
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner

b) Counter-Notification Procedure
If your content was removed in error, you may submit a counter-notice including:
- Your name, address, and electronic signature
- Identification of the material and its prior location
- A statement under penalty of perjury that the removal was a mistake
- Consent to the jurisdiction of the Canadian courts
6. Trademark Policy
The Thinktopia name, logo, and related marks are registered or common-law trademarks of LaClaire. You may not use these trademarks or similar variations in:
- Business or product names
- Web domains or subdomains
- Social media profiles
- Promotional materials or advertisements
Use of third-party trademarks within Thinktopia (e.g., for educational references) must follow fair-use and attribution requirements.
7. Enforcement and Violations
- We may remove infringing or suspect content without prior notice.
- Repeat infringers may have their accounts suspended or permanently terminated.
- We cooperate fully with law enforcement and legal proceedings regarding intellectual property violations.
8. Governing Law
This Policy is governed by the laws of the Province of Ontario and applicable Canadian law. Users outside of Canada agree to the jurisdiction of Ontario courts for all intellectual property matters.
9. Changes to This Policy
We may update this Policy from time to time to reflect platform or legal changes. Significant changes will be communicated via email or posted notice within your Thinktopia dashboard.
