Print-on-Demand Terms and Conditions

Please read these Terms carefully before using the Thinktopia Print-on-Demand service. By using this feature, you agree to be bound by these Terms, along with our Terms and Conditions, Privacy Policy, Children’s Data Protection Policy, and Intellectual Property Policy.
1. Definitions
- "Thinktopia" refers to the platform operated by LaClaire.
- "Service" means Thinktopia’s print-on-demand functionality integrated with third-party print partners.
- "Generated Content" means AI-generated stories, illustrations, and related assets created using Thinktopia’s Services.
- "Print Materials" refers to physical books and printed products created through the Service.
- "Print Partners" refers to third-party vendors, such as Lulu, responsible for printing and fulfillment.
- "User" means any individual or organization using the Service.
2. Intellectual Property and Content Generation
a) Ownership
- Thinktopia retains ownership of all underlying AI systems, code, models, and methodologies used to generate content.
- Users retain ownership of their input prompts, personalization data, and any uploaded media used in story generation.
- AI-generated content (stories and illustrations) is licensed to the user under a perpetual, non-exclusive, worldwide license.
b) Print License
Thinktopia grants users the right to:
- Order printed copies of AI-generated stories through authorized Print Partners.
- Distribute, gift, or sell printed materials for personal or commercial purposes.
- Create derivative printed works, provided they comply with attribution and branding requirements.
c) Restrictions
- Users may not claim authorship of Thinktopia’s AI system or its underlying technology.
- Branding, copyright statements, and disclaimers must remain intact on printed works.
- Printed works must not contain content that violates applicable laws or third-party rights.
3. User Acknowledgements
- Users acknowledge that all stories and images are AI-generated and should be reviewed before printing.
- Users are solely responsible for verifying grammar, layout, and appropriateness prior to submitting a print order.
- Thinktopia is not responsible for errors, omissions, or inaccuracies in printed materials.
4. Print Services and Limitations
- Printing and shipping are fulfilled by third-party Print Partners under their own policies and production standards.
- Delivery times, materials, and quality are subject to Print Partner capabilities and global supply factors.
- Minor color, alignment, or paper texture variations may occur and are not considered defects.
5. Quality Assurance
- Thinktopia and its Print Partners strive to ensure high-quality printing and binding standards.
- Any reprints or refunds due to manufacturing errors must be requested directly through Thinktopia’s support team within 14 days of delivery.
- Thinktopia is not liable for delays or damages caused by third-party carriers or customs.
6. Disclaimer and Limitation of Liability
THE SERVICE AND PRINT MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THINKTOPIA MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
- Thinktopia’s total liability shall not exceed the amount paid for the specific print order in question.
- We are not liable for indirect or consequential damages, including loss of profits or data.
- Users are responsible for ensuring compliance with local and international copyright laws regarding printed content.
7. Content Moderation and Rejection
- All content is subject to moderation before printing.
- Thinktopia reserves the right to reject or cancel print orders containing:
- Inappropriate, offensive, or illegal content
- Material that violates copyright or intellectual property laws
- Content deemed unsuitable for children or educational use
8. Commercial Use
- Users may sell or distribute printed materials commercially without royalty payments to Thinktopia.
- Users must not misrepresent the AI-generated nature of Thinktopia content.
- All commercial use must comply with applicable laws, including labeling and consumer protection regulations.
9. Termination
- Thinktopia reserves the right to cancel print services or revoke licenses for violations of these Terms.
- Repeated infringement or misuse may result in permanent account suspension.
10. Governing Law
This Policy is governed by the laws of Ontario, Canada. Any dispute related to printing or fulfillment shall be resolved in the courts of Ontario.
