Welcome to Thinktopia! These Terms and Conditions (“Terms”) govern your use of our website, located at https://thinktopia.ca, and any services, tools, or content provided by LaClaire. (“we”, “us”, or “our”). By accessing or using Thinktopia, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.

1. Definitions

"Thinktopia" refers to the website, services, and AI systems operated by LaClaire.
"Services" means all Thinktopia products, features, and content generation tools.
"User" refers to any individual or entity using the Services (parents, teachers, schools, or administrators).
"Child User" refers to any child under the age of 16 (or under 13 where COPPA applies) whose access is managed by a parent or educator.
"User Uploaded Content" means text, images, audio, or other materials uploaded or input by Users.
"Generated Content" means AI-created stories, illustrations, or related educational materials.

2. Acceptance of Terms

By creating an account, using the Services, or otherwise engaging with Thinktopia, you agree to these Terms, our Privacy Policy, and any additional terms that may apply to specific features. Parents and teachers acknowledge responsibility for supervising child usage and ensuring lawful compliance.

3. Use of Cookies

We employ the use of cookies to improve functionality, maintain sessions, and enhance user experience. By accessing Thinktopia, you consent to our use of cookies in accordance with our Privacy Policy.

4. License to Use the Services

Thinktopia and its licensors hold intellectual property rights for all materials generated or provided through the platform. We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, educational, and non-commercial purposes.

You may view, download, and print content solely for educational use within your household or institution.
You may not modify, resell, distribute, or commercialize AI-generated materials without written consent.

5. User Uploaded and Generated Content

a) Ownership and Responsibility

You retain ownership of any content you upload. By submitting content, you grant Thinktopia a license to store, process, and display it solely to operate and improve the Services.

b) Non-Infringing Content

You must own or have permission to use all uploaded materials.
Content must not violate copyrights, trademarks, or other rights.
You agree not to upload or prompt the generation of obscene, violent, discriminatory, or defamatory material.

c) Public Accessibility

Generated or uploaded content may be visible to the account holder and authorized users (e.g., parent or teacher dashboards). Thinktopia does not make child data publicly accessible.

d) Copyright and Takedown

If you believe your work has been used in a way that constitutes copyright infringement, please contact copyright@thinktopia.ca with details, and we will promptly investigate and remove infringing material.

6. Prohibited Conduct

Posting or generating material inappropriate for children under 13.
Uploading or disseminating harmful, violent, or explicit content.
Using the Services for harassment, fraud, or illegal activity.
Bypassing or interfering with site security or access controls.
Attempting to reverse-engineer, copy, or resell AI-generated works.

7. Intellectual Property

All intellectual property rights in Thinktopia, including text, software, AI models, graphics, and trademarks, are owned or licensed by LaClaire. Unauthorized use or duplication is prohibited.

8. Educational & Child-Safety Standards

All AI-generated content is designed to be family-friendly and age-appropriate.
We actively moderate story prompts and outputs for compliance with child-safety guidelines.
Teachers and parents are expected to review materials before classroom use.

9. Third-Party Services

We rely on third-party tools for hosting, payments, and analytics (e.g., AWS, Stripe, PHPMailer). Each third-party service operates under its own terms and privacy policies. Thinktopia is not responsible for external service failures or their content.

10. Indemnification

You agree to indemnify and hold harmless Thinktopia, its directors, employees, and partners from any claims arising from your use of the Services, uploaded content, or violation of these Terms.

11. Limitation of Liability

To the fullest extent permitted by law, Thinktopia shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our Services, including data loss or unauthorized access.

12. Termination

We reserve the right to suspend or terminate accounts violating these Terms or applicable laws. Termination may occur without notice for severe breaches, such as the uploading of harmful or illegal content.

13. Modifications and Updates

We may revise these Terms periodically. Material changes will be communicated via email or notice on the site. Continued use after updates constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada. Disputes shall be resolved through binding arbitration or the appropriate courts in Ontario.
